Terms of Service

1. Agreement

These Terms of Service govern your access to and use of Order Dash, including the online ordering platform, restaurant dashboard, website builder, Reel Deals and other add-on services (the "Services"). By creating an account or placing an order you agree to these terms. If you are accepting on behalf of a business, you confirm you are authorized to bind that business.

2. Accounts

• You are responsible for the accuracy of the information in your account and for activity that happens under it.
• Restaurant accounts are responsible for their menu content, pricing, allergen and dietary information, hours, and fulfillment promises.
• Diners may order as a guest; creating an account lets order history be linked to the email address used at checkout.

3. Orders and fulfillment

Order Dash provides the technology used to place orders. The restaurant is the seller of record for food and beverages and is responsible for preparation, food safety, accuracy, pricing, taxes and fulfillment. Estimated preparation and delivery times are estimates, not guarantees.

4. Fees and payments

• Payments are processed by Stripe. Restaurants connect their own Stripe account and receive payouts on their Stripe schedule.
• Platform commission, add-on subscription fees and delivery commission are shown in the restaurant dashboard and applied per order or per billing period.
• Where permitted, restaurants may choose to absorb fees or pass them to the diner. Fees passed to a diner are disclosed at checkout before payment.
• Fees are exclusive of taxes unless stated otherwise.

5. Refunds and cancellations

Refunds for food orders are issued by the restaurant through the dashboard and returned to the original payment method. Subscription add-ons may be cancelled at any time and remain active through the end of the paid period; fees already incurred are non-refundable unless required by law.

6. Acceptable use

• Do not upload unlawful, infringing, deceptive or harmful content.
• Do not attempt to access accounts, data or systems you are not authorized to access.
• Do not use the Services to send unsolicited messages — see our Anti-Spam Policy.
• Do not scrape, resell or reverse engineer the Services.

7. Content and ownership

You keep ownership of your menus, media, brand assets and customer data. You grant Order Dash a limited license to host, display and process that content solely to operate the Services for you. Order Dash retains ownership of the platform, software and its own brand assets.

8. Third-party services

The Services integrate with third parties such as Stripe, Square, Shipday, delivery courier networks, Google and messaging providers. Use of those services is subject to their own terms, and we are not responsible for their availability or actions.

9. Availability and support

We work to keep the Services available but do not guarantee uninterrupted operation. Maintenance, third-party outages and factors outside our control may affect availability.

10. Disclaimers and liability

The Services are provided "as is" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising from the Services is limited to the fees you paid to Order Dash in the three months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or lost profits.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these terms, suspected fraud, or legal requirement. On termination you may export your customer and order data.

12. Changes

We may update these terms. Material changes will be posted here with a revised date and, for restaurant accounts, notified by email. Continued use after changes take effect means you accept them.
